New York 

New York offers Disability Benefits (DBL) and Paid Family Leave (PFL) to eligible workers in the state. Employers can use an approved carrier to administer the NY PFL and DBL benefits.

Eligibility:

Employers

Any employer with one or more employees working in the state of New York.  

Employees

DBL

Full-time employees are eligible after working at least 4 consecutive weeks in New York. Part-time employees are eligible after their 25th day of employment.

PFL

Employees with a regular work schedule of 20 hours per week are eligible after 26 weeks of consecutive employment. Employees with a schedule under 20 hours per week become eligible after 175 days worked.

  • Non-occupational illnesses or injuries

PFL

  • Bond with a new child after birth, adoption, or foster care placement
  • Care for a family member with a serious health condition
  • Military exigency related to a family member’s active military duty or call to duty

26 weeks for DBL

12 weeks for PFL

A combined DBL/PFL maximum of 26 weeks in a benefit year 

DBL

50% wage replacement up to a maximum of $170

PFL

67% wage replacement up to a maximum of $1,151.16

There is a 7-day waiting period for New York DBL

There is no waiting period for New York PFL

Leave can be taken continuously or intermittently for PFL. Intermittent leave must be taken in full day increments.

New York DBL does not provide job protection to employees

New York PFL does provide job protection to employees

Additional information:  

Private Plans

Employers may opt out of the state plan in favor of a private plan. Unless an employer is self-insured for DBL, the employer must purchase DBL and PFL from the same carrier.

Covered Family Members

Under New York PFL, employees may take family leave to care for a family member with a serious health condition. Covered relationships include:

  • Spouse or domestic partner
  • Child (biological, adopted, or foster)/stepchild
  • Parent/stepparent/parent-in-law
  • Grandparent
  • Grandchild
  • Sibling
