New Jersey 

New Jersey offers Temporary Disability Benefits (TDB) and Family Leave Insurance (FLI) to eligible workers in the state.

Mutual of Omaha is excited to offer administration for the New Jersey Temporary Disability Benefits.  

Eligibility:

Employers

With certain limited exceptions, any employer with one or more employees working in the state of New Jersey.  

Employees

Employees must have worked at least 20 weeks in covered NJ employment, earning at least $283 a week or have earned $14,200 or more in the base year prior to leave or disability. Base year means the first four of the last five completed calendar quarters immediately prior to the disability.

Benefits overview

TDB

  • Non-occupational illnesses or injuries

FLI

  • Bond with a new child after birth, adoption, or foster care placement
  • Care for a family member with a serious health condition

26 weeks for TDB

12 weeks for FLI if taken continuously, or 56 days of leave if taken intermittently

85% wage replacement up to a maximum of $1,055

There is a 7-day waiting period for New Jersey TDB, but this is waived after 21 days of disability

There is no waiting period for New Jersey FLI

Leave can be taken continuously or intermittently for FLI. Intermittent leave must be taken in full day increments.

New Jersey TDB does not provide job protection to employees

New Jersey FLI does not provide job protection to employees

Private Plans

Employers may opt out of the state plan in favor of a private plan.  

Covered Family Members

Under New Jersey FLI, employees may take family leave to care for a family member with a serious health condition. Covered relationships include:

  • Spouse or domestic partner
  • Child (biological, adopted, or foster)/stepchild
  • Parent/parent-in-law
  • Grandparent
  • Grandchild
  • Sibling
  • Any other individuals related by blood
  • Chosen family and any other individuals whom you consider to be family
